SIA “Orca solutions” (registration No. 40203311834, legal address: Ādažu nov., Ādažu pag., Ādaži, Gundegu iela 17, LV-2164), hereinafter – “Bussin” – provides the content of the website and provides goods / services in accordance with with the uses described below.

GENERAL TERMS

If the consumer, using the goods / services of the goods through the website, such mutual agreement is considered a Distance Contract and an obligation to the legal norms of the Republic of Latvia governing the distance contract, including, but not limited to, the Law of the Republic of Latvia Regulations of the Cabinet of Ministers of the Republic “Regulations on Distance Contracts” etc.

PURCHASING

The prices and specifications of the products sold in the online store are indicated next to the products.

To place an order, you need items in your shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order is delivered after it is displayed on the screen. Make a purchase payment to complete your order.

PAYMENT RULES

The billing currency on the site is the euro. 

The purchase can be paid for with the Stripe payment platform:

Visa / Mastercard card payments

Personal data that pays for payments is transferred to a licensed payment institution, Stripe, Inc.

The purchase can be paid for with the Montonio payment platform:

Bank link payments. 

Personal data that pays for payments is transferred to a licensed payment institution, Montonio Finance UAB.

The agreement is valid upon successful payment to the bank account of the online store. If for any reason it is not possible to fulfill the order, the Buyer will be informed and the amount paid will be paid as soon as possible, but not later than 14 days after receipt of the order.

RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the Product within 14 calendar days from the receipt of the Product. (Depending on the product, the buyer may not have a mandatory right of withdrawal, in which case the reason must be clearly stated and explained). The right of withdrawal does not apply if the Buyer is a legal entity.

In order to exercise the 14-day right of withdrawal, it is allowed to use only for the purposes intended, which is responsible for maintaining the quality and safety of the product during the term of exercise of the right. If the goods are used improperly or damaged by negligent disregard of the instructions during use, if the original packaging of the goods is lost, or if its packaging is damaged, the online store is entitled to a refund according to the value of the goods.

To exercise your right of withdrawal, you must submit a withdrawal form to [email protected] within 14 days of receiving the goods.

The buyer bears the cost of returning the goods, except in cases where the return is not in accordance with the order (for example, the wrong or damaged product).

The Buyer is obliged to return the Goods to the Seller without delay, but not later than within 14 days after sending the withdrawal form to the online store. Upon receipt of the returned goods Bussin, but not later than within 14 days, refunding all payments received from the buyer to the Distance Contract.

The Seller has the right to detain until the confirmation of the return of the Goods or the goods is provided from the Buyer. If the buyer has chosen a different shipping method than the cheaper shipping method offered in the online store, the online store is not obliged to reimburse the highest shipping costs.

Bussin shall not be liable for any delay or non-performance of any obligation or other non-performance due to circumstances and obstacles beyond the reasonable control of the Online Store.

Bussin reserves the right to refuse to sell the goods and request the return of the goods from the Buyer, and the price quoted in the online store is higher than its market price due to errors.

CONSUMER RIGHTS FOR NON – CONFORMITY GOODS

Bussin is responsible for non-compliance of the goods sold to the Buyer with the terms or defects of the contract. The Buyer must inform the Seller of the non-conformity of the goods, within 2 weeks after its discovery, i.e. submit a complaint. The buyer can submit a complaint by contacting the online store at [email protected]

Bussin is not responsible for defects that occur after delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the elimination of defects in the goods or exchange for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller shall return to the Buyer all payments provided for in the Distance Agreement. The seller shall provide a written response to the consumer’s complaint within 15 days.

PROCESSING OF PURCHASER ‘S PERSONAL DATA

Bussin only processes personal data that the buyer has entered when ordering goods, such as name, e-mail, etc.

Bussin transfers personal data to the transport service provider (s) to ensure the delivery of the goods.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may contact you from time to time to provide information about our services and the latest offers. For this purpose, we may process the e-mail address you provided when signing up for marketing communications. The buyer has the opportunity to opt out of marketing communications by notifying us at [email protected]

DISPUTE SETTLEMENT PROCEDURES

In matters not stipulated in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

The Parties shall resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute is not resolved through negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, in compliance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Center or a court of the Republic of Latvia.

The buyer also has the right to apply to the European Union’s dispute resolution bodies.
